LEGISLATIVE REGULATION OF THE PUBLIC SERVICE SYSTEM IN THE REPUBLIC OF KAZAKHSTAN. POSSIBLE WAYS OF REFORMING

On November 20, 2001 in Almaty had taken place Round Table “Legislative regulation of the Public Service system in the Republic of Kazakhstan. Possible ways of reforming”.

Organizers: Transparency Kazakhstan, Association for cooperation with public service of Kazakhstan, Institute of the Law and State under the Kazakh Law Academy.

Participants of the discussion noted that in the Republic of Kazakhstan authorities take serious steps towards development of public service, strengthening of its professional level and effectiveness of its work. It is important that all those steps are purposeful. The united system of public service had been created, appropriate measures on ensuring this system with more accountability, transparency and accessibility for individuals have been taken. 

At that not sufficient adjusted legislation on public service stops large-scale reforming. Especially it concerns political positions. Legislative base in the part of political officials needs to be improved. It concerns the definition of “political official”, the base of transparency in formation of active list, legal status, criteria of responsibilities for made decisions, observance the legislation and activity results.

There are no clear legislative procedures and rational restrictions at the changing political position into work in business sphere and vice versa. This fact reflects the level of corruption and interferes with the fight against it.

 

In the end of discussion participants developed series of recommendations which can influence on improvement of the legislation on public service.
